Accelerated Examination - any thoughts?

Posted by Anonymous . updated on 2/26/2009
Wondering if anyone has tried out the new procedure for Accelerated Examination.  If so, any success stories with your petitions?  We've been considering it for some clients but are still trying to determine the cost/benefit.

On the one hand, I've seen First Action Predictions of over 100 months, so there is a lot to gain.  On the other hand, I've heard gossip that none of the AE petitions are being allowed, which would result in lots of extra cost to the client, and many admissions regarding the invention's patentability and/or claim construction.

I'd love to hear others' thoughts.

I've been trying to avoid them as best I can, so I haven't filed any yet...but bump for interest.

AE is probably well-suited for particular fields of art, moreso than others.   When the level of novelty is high, for example in the case of a new composition of matter such as a drug substance, which has a proven effect that cannot be predicted from its structure, one is better off with AE than they would be in the instance of a mechanical case, where the advance in the art represented by the proposed invention is of incremental degree.
