Assigning Patent Rights

Posted by Anonymous . updated on 3/11/2010
I work in a hospital and came up with a design for a product. Hospital like the design and they have been getting people and companies to work with me on the design. They want me now to assign all rights to the design product since they plan on submitting a patent application and pay me a $1.00 I was not hired to invent and it was not in the normal day to day process that I invented this product. I know they have some say due to the financial backing of the product in marketing , legal, research & prototyping. I am contacting a IP lawyer. My main concern is giving up the rights to the product. I know they have a policy on IT but is not problem. Any other questions or scenarios I should be concern with. The product I came up with is product that is used in all hospitals but I just made it more functionable. So all the time invested in this product was off work. Thanks

You may first need to check your original contract and search for the IP clause which would state who would own rights to the IP created by you during the term of your employment. Also it is an excellent idea to contact an IP lawyer. If you have any other queries feel free to give us a call.
