Can I file multiple provisional patents within a year (updates) to be used in the same non-provisional patent?

Posted by Anonymous . updated on 9/17/2009
I am working on a software program. It currently has one set of features, I expect to have another set of features in three months and another set of features in 9 months. In the mean time, I would like to be able to do audience testing without making people sign nda's. Is it possible to file a provisional patent now on the current set of features. Update it with a new set of features in 3 months and pay another $110 filing fee. Then file a non-provisional application in 9 months that includes protection for the original set of features at the original date, the next set of features at that filing date, plus anything added inbetween protected at the date of the non-provisional filing?

Hi there,

You posed an interesting question. Well, I would suggest you can choose your method of opting for 2 provisional patents with 2 different sets of features and then you would have 2 provisionals to convert into Utility within the period of one year.
Also, once converted if you have a third related set of features you may apply for protection under one of the converted provisional applications as a Divisional Application or CIP Continuation in part application.

Hope this helps,
