Can you US patent something that's already been invented overseas if you rebrand it locally?
Posted by Anonymous . updated on 10/7/2010
We are printing/selling a product in the states that is brand new and never before done, but was started in south africa. We found a competitor on the east coast US just now starting to do the same. We thought about getting a US patent for this product but we realize we did not "invent" this product, but merely reprint/rebrand it for a different purpose. The idea of the product is still the same. We found our competitor has a US patent pending for this product and I'm curious as to how they are managing that? I can go into detail what this product actually is (it's quite simple) and would love to find out if we should attempt to do the same.
Thanks,
Erik
