Changes to Provisional Patent application
Posted by Anonymous . updated on 8/17/2009
Is it true that the USPTO does not accept changes/corrections to provisional patent applications? If amendments need to be made to a provisional patent that's already been filed, what would be the best way to go about with the modifications (i.e. file a new provisional patent application, or file for a full, nonprovisional utility patent that incorporates the changes desired, based on the original provisional application?

Hi there,
Provisional applications are NOT examined on their merits. A provisional application will become abandoned by the operation of law 12 months from its filing date.
Thus the best way to go about modifications would be to give a broader scope in a full non-provisional utility patent based on the original provisional application.
