Character Licensing

Posted by Anonymous . updated on 2/26/2009
I 'm a illustrator and flash animator looking to start a licensing programme of some of my characters . My characters do not have recogintion as yet , however I'm confident they will sell. Sometime this summer, I will launch my website with my characters and animations. Is it possible for a licensing agent to take on a unrecognised property and market it? Do I really need an agent?

Well, a license is giving someone permission to use your property.  Before you get there, you need to have property.  I'd start with the Copyright forum.    It might be a stretch, but you might have some property rights in trademark as well.  But I think the bulk of your property rights begin in copyright.

Once you have your property rights, then you can start granting limited permission to use your property in exchange for money -- a license.

Regards.

I agree with Jim.  You certainly have copyrights in the artwork (assuming they're not unauthorized derivative works).

As for trademark rights, unless the characters have been used in connection with some goods or services as an identifier for such goods or services, you won't have trademark rights to license.  That doesn't mean that you can't license the works for others to use as trademarks, however.
