EU Patent

Posted by Anonymous . updated on 2/26/2009
Does a EU Patent have any rights in the USA  when only the registration is running in the USA?

How can i make some contacts to licensee or buyers?

An EU patent is not enforceable in the US.  A US patent is not enforceable in Europe.

I'm not sure  what you mean by "registration is running."  If you mean to ask whether a corresponding US patent pending/issued in the US is required for rights in the US, that's correct.

Regards.

Sorry for my bad english.

I already recived the EU Patent and in the USA Patent pending.
I am trying to get some contacts to licensee or buyers for the future, or maybe a Patent agent for some help.

A few companys in europe would like to buy the patent but it should worth quite more in the USA.

It is a new method and device for authentication.

Just a note on U.S. terminology:  a "patent agent" is a non-lawyer who is qualified to write patent applications and represent others before the United States Patent & Trademark Office in patent matters.

There is no reason to believe that the typical patent agent is particularly well qualified to help you license your patent.

Ok ty for that info.

Back to my first question, when the Patent is only pending in the USA where are my rights over there?
For example infringement.

best regards
ronnie

Until a U.S. patent has granted the application gives no particular rights.  Once the patent has granted you may, under certain circumstances, be able to collect reasonable royalties from an infringer starting from when the application published.
