Exact Duplicate Claims

Have discoverd an issued patent with idenctical duplicate claims. i.e. Independant Claim 4 is identical to independate claim 12. Claim 4 has some dependant claims while Claim 12 has no dependat claims.
Questions are - Is there any question to Patent validity? Could not at least Claim 4 or 12 be invalid? And then if so which one?
