How to Draft 'System' Claims
Posted by Gregory Duncan. updated on 11/30/2009
I am responding to a 102 rejection citing 3 examples of prior art. 1 of the three, I should have no problem explaining the various dissimilarities; however, the other two examples of prior art do seem to share a common mechanism. What I noticed was that both the prior art examples were used in a more industrial application, while mine would be utilized in a more civil/stormwater (drainage) application. The advice I was given was to formulate my claims as 'system claims' specific to my field. However, I cannot find any materials or examples to help me learn how to do this :(.
Any advice?
