How to file a petition for Notice of Abandonment?
Posted by Anonymous . updated on 12/31/2010
We have received notice of Allowance and Fee Due(PTOL-85) On September 8, 2010. We contacted with USPTO Inventor Assistance Center by phone. An retired examiner told us that we have four months to respond since that date. That means the deadline for respond is January 8, 2011.
Now, we received Abondonment Notice issued on December 22, 2010, stating that the deadline is December8, 2010. It states that the applicant's failure to timely pay the required issue fee and publication fee.
pettitions to revive under 37 CFR 1.137(a) or (b) should be promptly filed to minimize any negative effects on patent term.
Is that our fault? What should we do now? We want to have our issued patent.
