In lieu of steps dependent claims
Posted by Anonymous . updated on 2/26/2009
I am contemplating whether it is possible to substitute certain steps from an independent claim with alternative in a dependent claim such as example below.
1. A method comprising:
a. Use hand to open tap b. Add soap to hand c. Rub hands together with tap d. Use hand to close tap e. Rub hands with towels until hands dry
2. A method according to claim 1 whereby instead of performing steps d & e, the following step is perform comprising:
a. Put hands under a hair dryer.
Obviously the alternative is to write 2 as independent.

The dependent claim is used to add additional features and/or to expand upon previous claimed features, thus a dependent claim cannot substract an element from the claim in which it is dependent. In your hypo, you are substracting d and e and adding a limitation, this you cannot do.
