International Priority Rights

Posted by Anonymous . updated on 12/28/2009
I am negotiating with a company who have a patent registered in Japan. Patent granted just over 2 years ago.

They have not registered patent outside Japan.

I want to licence the product or negotiate assigning the international rights so I can register the patent in the US and EU etc..

Do they still have any priority rights to international patents to be offering?

i.e. is it too late to register the patent outside Japan and can any of our competitors start to manufacture copies without us able to do anything to stop them?

Thanks

No you would not be able to do that as you are NOT the inventor or the licensee or the assignee either!

Also the company that owns the patent cannot file for international priority rights as they failed to file within the specified time period alloted
