Inventor Rights regarding 37 CFR 1.47(b) Petition
Posted by Anonymous . updated on 12/12/2010
Inventor Rights regarding "37 CFR 1.47(b) Petition" How does an Inventor let the Commissioner for Patents know a Declaration stating proof of priority interest AND statement that a court in the jurisdiction would by weight of authority in that jurisdiction award title of the invention to Rule 47(b) submitted in a patent application is false and untrue? For example, an inventor invents an invention at home and using his own equipment under California Labor Code 2870 and therefore owns their invention. But without the inventor's knowledge a patent application is submitted claiming the inventor used the companies equipment. this is a false statement and can be proven to be false in a court of law. How does the inventor submit a request for continued dismissal of the petition when the applicant is lying to get his way?
