Ownership rights
Posted by Anonymous . updated on 7/21/2010
I was a non paid partner in a corporation and assigned my patent to the company. I also have a consulting business that funded the idea and prototype work for the patent. The consulting business was never reimbursed for any of its work. The corporation said they didn't owe the consulting business anything because there was no contract between the two companies. As a partner I was authorized to contract to individuals for services. Does the consulting business have any ownership in the patent / ideas and should the consulting business been required to assign it right to the patent?

Ideally, if there is an express written agreement that assigns patent rights for inventions made to the Consulting business, then you are required to assign the patent right to the Consulting business. But if no written agreement exists, you own any patent rights on the inventions.
