Patent Rights as a Consultant
Posted by Anonymous . updated on 1/5/2011
I am a design consultant. A US based client of mine paid me to help him with improving a product. Prototypes proved that the design was far superior than they imagined. To protect themselves, my clients applied for a patent and used the written work that I provided right in the patent document itself.
We had a purchase order agreement that covered my time for the work which was paid in full. There was no agreement; verbal or written relating to patent rights as we had no idea while I was doing the work that it was even patentable.
Patent protection has resulted in my client obtaining a single source contract to produce this product. I was originally told that this was worth hundreds of millions of $ in sales to this company.
Do I have a valid claim against my client for the unrecognized patent and the benefit they have recieved from it?
