Patent Search Results for Canada
Posted by Anonymous . updated on 8/13/2009
When searching the database of Canada's Patent Office, I understand the results of any given search includes patents that have been granted, or published but not yet examined. My question is, can I also search for patent applications that are pending but not yet published? The reason is, I want to apply for a patent in Canada, but want to find out if someone else has already applied.

Hi there,
We are glad to know that you are being thorough in searching for prior art to evaluate your invention and the chances of your getting a patent in the same domain as the prior art.
However, you needn't evaluate UNpublished patents since they would not be considered as being in the public domain.
Although there is a thin line between an UNpublished patent that need not be evaluated and a related patent that is Published and needs to be evaluated since it may disclose virtually the same invention.
To make it clearer, the basic concept is that one need not bother about UNpublished patents but rather concentrate on those related patents that are Published and within public domain and may be evaluated easily in light of the invention, one seeks to patent.
