Patent Use when patent owner is deceased.

The creator of a patent on optical flashlights has deceased. Can I take the patent and run with it and create a product? Do i need to wait for his son to act on it? If I get permission from his son does that make it okay to create a product similar to the patent? Do I have to wait the 20 years for the patent to expire?
