Patentability of a product
Posted by Anonymous . updated on 8/13/2009
If I have an invention that works essentially the same way as an existing invention, and has a similar internal composition of materials, but is novel by way of addition of a very distinct physical attribute that in itself serves to solve a problem of the 'original' invention, would this likely be patentable? How do patent examiners judge exactly how 'novel' an invention is, compared to the prior art?

Hi there,
A Prior Art Search would help in knowing better if the physical attribute is indeed novel and solves a worthy problem of the "original" invention.
You may view our services on Prior Art here: http://www.patentexpress.com/patents/prior_art_search_price.aspx
Patent Examiners view how novel and/or utilitarian an invention is by cross referencing it in the light of prior art.
