Please Help!

Posted by Anonymous . updated on 2/26/2009
Hello,

I have a serious question. I have done original artwork of a famous person. I decided to make a personal t-shirt and now people are asking where they can get one. Can I use the artwork on my shirt with that likeness or do I need permission first? I celebrity on the shirt is now deceased, do I get permission from this person's family?
Please help me! There is a lot of money that can be made if I can use the likness.

Elijah J.

That's a copyright issue.  You'll get much better response on the copyright forum:

I think it is more of a right of publicity issue than a copyright issue.

You'll be looking to the estate of the deceased for permission, in all likelihood.

Thanks, you're right.  I misread the original post.

Hmmm.... is there a forum for that here?  Miscellaneous?  Copyright might be close enough to get some experienced perspectives.

It's certainly not patents.

Regards.

I'm pretty sure you do. But if you want a case on point, check out the recent Catherine Zeta-Jones case in which the defendant tried to use her image in advertizing their topless bar. She won. As to all the arguing about what area of law this would fall under, again, whatever area that case falls under, yours would be too.
