All Questions in Is it Patentable? >> potential patent through programming

potential patent through programming

Posted by Anonymous . updated on 1/21/2010
Hello,
My partner and I own a start up and have 3 things that we believe may be eligible for a patent. One of which we estimate 90% chance of getting, one at 75% and one at around 30%.
1) Using code that already exists for and in a new way; for example, (this is not the idea) using a screen share program to give you access to your own computer elsewhere in the world like a live virtual PC. Would something like that be eligible for a patent?
2) Lets say there are many little programs that all work individually but I was to put them together, which requires more than just putting each parts coding together, it requires a new program to make them work together. If I were to do something like that would it be eligible for a patent?
and 3) Lets say Baskin Robbins offered online ice cream but only ice cream. If i were to create a company that offered ice cream and added a program that allowed the user to create custom ice cream cakes. Would either the concept of allowing custom ice cream cakes online be patentable or would the way in which our system allowed it to happen be patentable?

Thank you

Josh

I wouldn't know which of the 3 questions you have rated as per the chances of 90% , 75% and 30%. However, the answer to your first question is, yes it is patentable. The answer to the second one would be pure software code is considered unpatentable. And the third question's answer would again be a no.
