Protecting a database product--trademark, patent?

Posted by . updated on 1/18/2006
I am developing a database product and will sell access to it on a subscription basis. There is no comparable product that organizes and packages the info as this will. What do I need to file to protect my idea and keep others from just copying the product? A trademark for each database? A patent? Copyright? It's confusing. The information captured is available publicly, generally, from a wide array of sources and this product provides the user with an efficient and convenient means of getting data that would take hours or days to gather normally. What is unique is how it is organized and presented, not that the information itself is gathered through a proprietary method.

Depends on the way the info is organized and packaged. Is it accomplished through software? If so you need copyright protection. If it is a unique business system (unrelated to software) you may need patent protection (considerably more difficult and expensive.) Call or email for further assistance.

To add to what Mr. Anderson wrote, if your work qualifies for copyright protection and does not infringe on someone else's property, it will automatically be protected once it is put into a medium, such as a software program. If you would like to discuss any issues further, please feel free to contact my office. My contact information is below. Thank you.
