Public disclosure and provisional
Posted by Anonymous . updated on 8/3/2010
I disclosed my invention 10 months back. Now I realized that it has good market potential, so like to patent it, but don’t have time to prepare a patent. Can I file a provisional in a month and file a patent with in a month?

Yes, you can file Provisional patent application within one year of the date that you first publish, commercially use, sell, or offer your invention for sale. This applies to inventors in any country that apply for a US patent. If you wish to preserve your foreign rights and prevent theft of your invention, file your patent application before you publish or sell your invention.
After filing the Provisional patent application there will be one year time to convert it into Complete Utility patent application.
