solution to a well known problem

Posted by Anonymous . updated on 2/26/2009
Hi,

I am working on a solution for a problem that is pretty well known (the problem part, I mean)
I am doing some amount of research but I am very sure that the solution I am providing will
be unique unless someone else was thinking exactly on the same lines as me. Firstly,
1) Is my understanding correct?
2) Is this patentable?

Regards,

PS:
Just as an example:
In the SW world, the aim is always to improve quality of product (meaning less bugs)
Many people have provided different techniques to eliminate as many bugs as possible.
And lot of them have patented these methods. Now if I have invent a new method, what
are the basic requirements?

yes, your invention may be patentable. It depends on if your solution is novel and not obvious or not.

First of all new way of solving a probem that was not obvious is patentable. Yes there might be others working on same problem therefore the one who first files for patent is the rightful owner. Also note that approch of every other person to a problem in not identical there are bound to be some differences in approch.
