Trademark versus domain name

If I buy for example the domain name Ilovebooks.com and somebody after me trademarks the words I love books, who will one day have the right to sue the other to get the name back?

In my opinion I would win because I bought it first even though has no trademark.

Interesting point. But does your domain pass the test of likelihood of confusion with the mark ilovebooks? In other words, will consumers be confused with your domain used in particular for your business and with the other similar mark to yours?
If yes, then you may win.
It is always best to trademark your domain name, business name and logo if any as these represent your brand's identity in the consumers minds
