Trademarks and Patents
Posted by . updated on 4/21/2009
I registered a domain name I am planning on building a website using the domain I purchased. I did a search on the domain and found that the name has a trademark Abandonment Date - two things: 1) Can I trademark this name since it currently is showing an abandoment date. 2)Since I have registered the dot com succesfully a few years back, will this cause any conflicts with the dot org and dot net registrants such as trademark and patent

This cannot be answered by a simple yes or no. The only way to determine if your proposed mark may be clear is to hire a trademark attorney (not a business attorney) to conduct a comprehensive TM search and analysis, and only then based on his interpretation, your question can be answered. Please refer to the trademark articles and videos on my website.

You should be able to file for mark protection if you qualify. You can consult with me about these other issues; there is a lot you need to know when you start an online business.
