TV Character name

Hi,

I currently work on a variety show and I am known by  a name other than my birth name. Does the TV show retain the use or own the name? Can I trademark that name to use on product labels or a clothing line or even another TV show? People on the streets recognize me a call me by this TV name. Incidentally, there's a movie being produced using the name with no afiliation with the tv showor me.

That's an interesting question and a difficult one to answer on the facts you've provided.  Much hinges on the contractual  terms between you and the show owners, I imagine.  Furthermore (or perhaps even more importantly), it's not clear that the character name is actually being used as a trademark in the first place.

Thanks for your reply Jeff. I will look into the paper work I signed with personel. I was hired as a daily hire and have not signed a standard contract. Basically, I am a free agent and can work on other shows.

How can I check if they are using my character name as a tradsmark. I have looked at the trademark databases and I have found nothing realting to my show.

And finally, can I trademark a name, character name, actors name, or a personality?
