Not really, because you have constructive notice. If the patent is published, the law says you could have looked up that information. If you do it willfully or you do it intentionally, you may be subject to additional penalties. In particular, these penalties will be monetary in nature, triple the amount of the compensatory damages that the patent owner might get.
