How to make a patent settlement out of court? Video Transcript

Here I am going to discuss how one can settle patent disputes without going to court. First is to get a settlement negotiation with the other party. Because litigation is very expensive, settlement negotiations can be informal between the companies or parties, or they can be a little more formal. Alternate dispute resolution can be elected by both parties through either mediation or arbitration. Mediation is non-binding on the parties but helps achieve a common ground that they both agree on. Often, arbitration is a quicker method, but it is still an evidentiary hearing. It is not necessarily the full evidentiary hearing of the court system, but something that could potentially be binding upon the parties. Those are the primary ways of settling patent disputes without going to court.
