Generally, what could be infringed is the claims of the patent. The ownership's permission also can be infringed; not really infringed, but the ownership's permission to use or license the patent may not be received and therefore the claims of the patent are primarily what is going to be licensable. The infringement basically means that the claims of the patent are being practiced by some other product or service by another company. Generally, people infringe claims or companies infringe claims when they practice or develop a product, manufacture a product, sell a product that is protected by an issued US patent.
