How to write a Summary for your utilty patent application? Video Transcript

In this section we are going to talk about the summary and write the summary of your invention. The summary of the invention should mirror your independent claim. The independent claim that you just wrote that took your primary elements and converted them into legal form is primarily going to be your summary. The summary is just going to indicate to a reader what your invention does. You have to be careful in summaries that you do not say a bunch of extra stuff that you did not incorporate to independent claims because those things could be read in later if your case got litigated. Your dependent claims, if you do incorporate them into the summary, write them in plain English sentences. The summary should be written in plain English sentences, translating your claims to plain English sentences, but the dependent claims, if they make it in, should be written with the may or can. You do not want to limit your invention to the limitations of your dependent claim because your independent claims should stand on their own. So the summary section helps the reader identify quickly what is the invention about and what are the limitations of the invention particularly those that were in your independent claims. Be short it is not too long and do not incorporate things that you did that did not make it into your claims.
