What is a Foreign Filing Receipt? Video Transcript

In this section, I am going to talk about the foreign filing receipts and when you can foreign file an application filed in the US. After filing an application in the US, usually the US Patent Office will give a blue slip which comes with the patent filing number which allows the application to be filed in foreign countries and a foreign filing license is received at that time. Sometimes it does not come with the receipt and one has to wait six months for the US Government and the Patent Office to review it for potential secrecy implications. If the invention gets a secrecy order, which means it is subject matter to something the Patent Office believes is a national security issue or related to atomic energy, then it becomes harder for one to get a foreign filing license. It may be precluded to file in foreign countries without a complicated procedure and the guidance of a patent attorney is usually needed at that point. The invention that is subject to a secrecy order, if the federal government uses the technology subject to the secrecy order, they will compensate the inventor and owner of the patent. Usually this comes about when the patent relates to atomic energy or nuclear science or sometimes avionics.
