What is a Second Office Action?

What is a Second Office Action? Video Transcript

The Second Office Action comes after you have already responded to an office action once. If the examiner agrees with you, they might give you new rejections with new references. If they do not agree with you, they might make the Second Office Action final, which means that you cannot amend things anymore and the case is going to go abandoned unless you convince the examiner this time or you pay money to keep the case alive by filing this thing called an RCE. So the main goal with the Second Office Action is similar to the first. You want to address each and everything that the office action says and either do an amendment to the claims and narrow them in scope or submit remarks to overcome the references that are cited against you.
