In this section, I am going to discuss how does one appeal a patent application after Final Office Action. After Final Office Action, you could file a petition to appeal the case to the Board of Patent Appeals and the USPTO who will consider the case. If you really believe your Final Office Action is incorrectly presented and you do not want to pursue an RCE because you are probably going to get the same examiner, you can appeal the case and that will move the case to a group of people after a year or two who is going to review the case with the board of supervisor patent examiners who look at appeals of why your patent should be granted and when they make the judgment independently, you can try to get your patent issued at that time. So it is a way to delay the abandonment of your case by filing an appeal of the Final Office Action and let it be examined and evaluated by the Board of Appeals at the patent office.
